First Not Last — Terms of Use

These terms are the end-user licence agreement (EULA) between you and Russell Bolger ("we", "us"), who makes and runs First Not Last, the online sailing race game. By creating an account or playing online you agree to them. If you don't agree, don't use the game.

1. Who can play

First Not Last is rated 18+ in the App Store because players can meet other people online. You must be 18 or older to create an account or play online. Learn to Sail and the offline modes need no account.

2. Your account

• Give a real email address, keep your password to yourself, and keep your account to yourself: one person, one account, open on one device at a time.
• You are responsible for what happens under your account.
• You can delete your account at any time in the game (Account → Delete Account). Usernames that have been used stay reserved, as the privacy policy explains.

3. What you may not do

Other sailors see your username, the names you give races, and the quick calls you shout in a race. You may not use any of them, or your behaviour in a race, lobby or friends list, to:

• post or show anything hateful, discriminatory, sexual, obscene, violent or threatening;
• harass, bully, stalk, impersonate or embarrass another person, or share their personal information;
• promote anything illegal, including self-harm or the abuse of children;
• pick a username or race name designed to get around the word filter (for example by swapping letters for numbers);
• cheat, exploit bugs, wreck other sailors' races on purpose, or use tools that give you an unfair advantage;
• spam other players, advertise, or send false reports.

4. Filtering, reporting and blocking

• Filter. Usernames and race names are checked against a list of blocked words when they are chosen, and refused if they match. The filter is not perfect, so it is not the only protection.
• Report. You can report a sailor's username, behaviour or the name of a race from the lobby, the friends list, the pause menu and results screen during a race, and Account → Report or Block a Sailor. You can also write to russellbolger06@gmail.com.
• Block. You can block any sailor at once from the same places. A blocked sailor is removed from your friends, can't send you friend requests, and the races they host and the quick calls they shout are hidden from you. Account → Blocked Sailors lists and unblocks them.

5. What we do about it

We review every report within 24 hours. If it shows that these terms were broken, we remove the content (for example by renaming the account or closing the race), and we eject the player who made it: their account is banned, they are removed from any race they are in and they can't sign in again. We may also warn a player, or ban an account straight away for a serious breach, without warning. Coins, skins and other items on a banned account are not refunded. If you think we got it wrong, write to us and we will look again.

6. Licence

We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the game on devices you own or control, for your own non-commercial use. You may not copy, sell, rent, reverse-engineer or modify the game, or build services that talk to our servers, except where the law lets you. The game, its artwork and its sounds belong to us.

7. The game's rules and items

Coins and sail skins have no cash value and can't be bought, sold or exchanged for money. We can change prices, rules, rankings and the Daily Racing schedule at any time, and may reset a leaderboard if results were affected by cheating or a fault.

Premium is an optional monthly subscription bought through the App Store. It renews automatically each month at the price shown in the game until you cancel, and is charged to your Apple ID when you confirm the purchase. To stop the next renewal, cancel at least 24 hours before the end of the current month in your App Store account settings; Premium then lasts until that month ends. Refunds are handled by Apple under its own policies. Premium belongs to the First Not Last account it was bought on. What Premium includes (such as its daily gifts and features) may change over time, and its coins and crates follow the rules above.

8. Availability and our responsibility

We do our best to keep the servers running, but the game is provided "as is", and it may be unavailable, change or stop at any time. To the extent the law allows, we are not liable for lost progress, lost items or indirect loss. Nothing here limits rights you have by law as a consumer.

9. Apple

This agreement is between you and us, not Apple (or Google, for the Android version). Apple has no obligation to provide support or maintenance for the game, and is not responsible for claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple's own minimum terms for licensed apps also apply.

10. Ending this agreement

You can stop at any time by deleting your account. We can suspend or end your account if you break these terms. Sections 3 to 5 and 8 survive after it ends.

11. Changes and law

If we change these terms in a way that matters, we raise the version above and the game asks you to accept them again before you play. These terms are governed by the laws of Ireland, and its courts decide any dispute, except where the law of your country gives you the right to use your own courts.
